There are two forms of child custody within the State of Georgia: Physical and Legal. Physical custody determines where the child or children will resided for the majority of their time and also determine where the child or children will visit during their visitation time. Legal custody on the other hand determines how decisions will be arranged on behalf of the child in terms of education, health, religion, extracurricular, etc.
During a divorce preceding including contested child custody the court uses the best interest of the child to determine each custodial arrangement. In rendering the decision of child custody the court will take into consideration the child’s current living arrangements, each parent’s living arrangements, the child’s health, and the child’s general needs. Georgia family courts require that all divorced parents must file a parenting plan with the court that includes how each individual intends to divide the parenting time including: holidays, birthdays, and must include specific times and transportation information for how , where, and when the child or children will be exchanged.
Each parent must additionally identify which specific legal authorities that they intend to make on behalf of the child and whether there are limitations to their abilities to make decisions. Individuals may also be able to determine if the final decision authority should specifically be made between the parties or must be arbitrated through a neutral third party. Furthermore, within the parenting plan parties may establish a specific set of rules or protocols for reaching an agreement upon a decision on a particular area. It is required that each parent submit their own individual parenting plan to the court when there is any type of disagreement over decision making authority or visitation scheduling.
In considering child custody situations the state of Georgia allows for children age fourteen (14) and over to indicate preference of which parent they wish to reside with. This preference must reflect positively within the best interest of the child and if the court disagrees with the preference may have the ability to override or not take into consideration the child’s preference.
Child Custody arrangements are subject to modification by the court. In instances of a substantial change of circumstance the courts may re-evaluate the original custody order. Substantial changes of circumstance may include: changing needs, moral misconduct, remarriage, or relocation situations.
